Welcome to Souq by HalalHQ

Souq operates on Islamic commercial principles with a trust-based payment system designed to protect both buyers and sellers. This agreement outlines how payments work and your obligations as a seller.

Trust-Based Payment System (Amānah)

HalalHQ holds customer payments in trust (amānah) until delivery is confirmed, ensuring compliance with Islamic commercial law and Australian Consumer Law (ACL).

How It Works:

Customer places order and pays through HalalHQ
You fulfill the order and ship the product
Early Payout (20%): When your package is shipped or picked up by HalalHQ
Delivery is confirmed (via carrier or photo proof)
3-day hold period begins (Souq Amānah via secure payment hold)
Final Payout (80%): Released 3 days after delivery - that's it!

Self-Fulfilled vs HalalHQ Fulfilled

Self-fulfilled orders (you ship via carrier): You keep 93% of total (product + shipping) after 7% platform fee. You handle postage costs.

HalalHQ fulfilled orders (we handle delivery): You get 93% of product price. Shipping fee goes to HalalHQ to cover delivery costs.

Why the 3-day delay?

The 3-day hold balances Souq Amānah with faster seller payouts. Buyers are protected under Australian Consumer Law for defective items, while sellers receive funds quickly. Early payouts (for DELIVERY orders) provide cash flow while the package is in transit.

Delivery Confirmation

You can confirm delivery in two ways:

Automatic (Recommended)

Use Australia Post or Sendle for automatic delivery confirmation via carrier webhooks

Manual (Self-Delivery)

Upload a photo showing the package at the delivery location as proof

Seller Obligations

As a HalalHQ seller, you agree to:

•Inventory Ownership: Only list products you own or directly control. Dropshipping (forwarding orders to third parties) is prohibited.
•Listing Types: Clearly indicate "Ready Stock" (ships immediately) or "Pre-Order" (made/sourced after purchase).
•Timely Fulfillment: Ship orders within the promised timeframe. Late deliveries affect your seller metrics.
•Accurate Descriptions: Provide truthful product information, including halal certification status.
•Quality Standards: Maintain high product quality and customer service standards.
•Dispute Resolution: Respond promptly to customer inquiries and resolve issues professionally.

Prohibited Practices

✗Dropshipping: Forwarding orders to third-party suppliers without owning inventory
✗Misleading Information: False halal claims, fake reviews, or deceptive product descriptions
✗Price Manipulation: Artificially inflating prices or engaging in unfair pricing practices
✗Non-Halal Products: Selling products containing alcohol, pork, or other haram substances

Consequences of Violations

Violations of this agreement may result in:

• Suspension of seller account
• Withholding of pending payouts pending investigation
• Permanent ban from the marketplace
• Legal action for fraud or misrepresentation

Performance Metrics

We track the following metrics to ensure marketplace quality:

• Successful order completion rate
• On-time delivery percentage
• Customer satisfaction ratings
• Cancellation and refund rates
• Dispute resolution time

Good Standing Benefits: Maintaining high ratings and low dispute rates ensures your account remains in good standing with full payout privileges.

Payment Processing

All payments are processed securely through HalalHQ. You'll need to:

• Provide valid business information during registration
• Provide bank account details for payouts (Australian bank account required)
• Maintain accurate tax information (ABN for Australian businesses)
• Keep your seller account in good standing

By Selling on Souq:

You acknowledge that you have read, understood, and agree to:

• The 2-step payout system (20% early, 80% final after 3 days)
• 3-day hold period after delivery confirmation
• All seller obligations outlined above
• Prohibition of dropshipping and other restricted practices
• HalalHQ's right to withhold payouts or suspend accounts for violations
• Collection and use of performance metrics

This agreement was automatically accepted when you registered as a seller
